Macleay Island Couple Win QCAT Benchtop Dispute

A Macleay Island couple has won a Queensland Civil and Administrative Tribunal (QCAT) claim against a kitchen supplier over an undelivered stone benchtop.

Gerry Lincoln Hansen and Fiona Michelle Lawton took action against Geoffrey Anderson Jarvis, trading as Kitchen Perfection Qld, after paying $25,530 for a stone benchtop that was never supplied or installed as part of their home renovations at 2 Keith Street.

The couple had contracted Jarvis in May 2023 to supply and install kitchens, bathroom and laundry cabinets, wardrobes, and a built-in entertainment unit.

Work on the project commenced in April 2024, but by late July, the supplier reportedly indicated he would not complete the stone benchtop installation.

Despite repeated notices from the homeowners, Jarvis failed to respond.

The couple subsequently terminated the contract in August 2024 and lodged a claim with QCAT seeking a refund of the amount paid for the benchtop, plus filing fees.

QCAT Member S M Burke ruled in favour of Hansen and Lawton, ordering Jarvis to pay a total of $22,409.50—covering the benchtop payment and application fees—by 1 December 2025.

The tribunal noted that the builder had partly completed other works, but the stone benchtop was not delivered, and the respondents failed to provide evidence or respond to directions.

The case highlights the importance of compliance with contractual obligations and timely responses to consumer claims in the building and construction sector.
